Congress should repeal JASTA

Editorial by the Wisconsin LGBT Chamber of Commerce argues that Congress should repeal the Justice Against Sponsors of Terrorism Act (JASTA) because the act, while noble, will have consequences too grave to ignore.

Late last month, Congress met and overwhelmingly voted to override President Obama’s veto of the Justice Against Sponsors of Terrorism Act (JASTA). This vote came despite being denounced by government and military officials from across the political spectrum.

The intent of the law initially was to bring peace and justice to the families of the victims of the attack on 9/11. While this goal is undoubtedly admirable, the potential consequences and precedent this legislation will set as it is written are too grave to ignore.

As an organization of, gay, lesbian, bisexual, transgender and LGBT-allied businesses, corporations and professionals, the Wisconsin LGBT Chamber of Commerce has always been focused on building a strong pro-fairness business community.

Among the more than 470 businesses and organizations for around Wisconsin the Chamber brings together, there are several that are also veteran owned businesses, and all are supported by the men and women who have fought for our country. It is with them in mind that we urge Congress to repeal JASTA.

One of the most worrisome consequences is that this law undermines the long help principle of sovereign immunity, which promotes disputes to be worked out between the nations involved rather than in the courtroom. If other countries follow the footsteps of the United States and adopt their own versions of this policy, American military personnel both at home and abroad would be put at risk of being sued in foreign courts. That would ensue, including classified information being requested for lawsuits by foreign governments and diverted resources, is far greater than the potential benefits.

The men and women who put their lives on the line and fight tirelessly to ensure the promise of American freedom is held safe should not have to worry about having charges brought against them by other nations.

As an organization comprised of business owners from across the great state of Wisconsin, there is also concern about the economic effect this law many have in the long run. If Saudi Arabia makes good on their threat to see off their American assets, that could have a devastating impact on our economy not only here in Wisconsin, but across the nation.

Bringing justice to families of the 9/11 victims is a worthy and noble cause. JASTA, unfortunately brings little promise of tangible results and regrettable consequences that can and should be avoided. Taking this all into consideration, Congress should repeal JASTA and work together on legislation that can being real justice to these families.
